With an eBay Buyer - 6519kirby. Hopefully Mr Kirby of Clifton isn't a member on TamiyaClub, as his attitude stinks.

After paying the reasonable sum of £13.30 including postage for some genuine Tamiya Mini Cooper Wheels, Foams and Tyres described as having 'excess glue' on the rim from my cack-handed attempt at gluing he has -

- Requested £3 back on receipt of the item

- Threatened negative Feedback if demands are not met

- Opened a dispute requesting a return or full refund

So I may have lost my temper a little in my latest response to him -

Dear James,
You Sir, epitomise everything which is wrong with eBay. You have purchased an item which has been clearly photographed, accurately described and you had outbid other interested parties on this item. Upon receiving the item you immediately assumed that it was worth less than you had actually paid, so wanted some of your money back (£3). This process is bizarre, since if you thought it was only worth £3 less than you had bid, you really shouldn't have gotten so carried away during the auction. This is what we call buyers remorse, you bought it, you now don't like what you paid for it, but because this is eBay it allows you to operate outside of what would be considered common sense.

The item is now yours. Not mine. You bought it - from me. If you don't now like it, you sell it on. This is how 'life' works. However, this is not how eBay works, so now - some 30 days after receiving the item - you are somehow entitled to contest your purchase and hold me accountable for your dissatisfaction.

To really make this story complete, I should also mention that you have been reported to the eBay fair usage policy on feedback extortion following your email message on the 28th September where you threatened negative feedback. This is being processed now, and I'm surprised it hasn't prevented you from opening this case so late after the original purchase date (27th August). So, where do we go from here? Well, the whole £13 we are debating is now 'frozen' in time because of this petty dispute, but I'm happy for it to stay there. This will likely go in your favour, because it seems historically that eBay don't like dealing with difficult people and therefore I wish you the best of luck with your endeavours.

I'm going to log off now, and suggest that you have a good long think about this whole debacle. If you think this email is written with a condescending undertone then at least that is one piece of comprehension I can congratulate you on - if only you paid so much attention to reading item descriptions we might not be having this discussion.

It will probably end in tears but I at least feel satisfied that I have put my point across. People like this ruin eBay for the rest of us - put people like me off of selling anything in future as it's simply not worth the hassle. Whatever happened to common sense anyway?!

Unfortunately common sense isn't anywhere near as common as we'd hope! And there are far too many of this type of muppet who try to swindle sellers and ebay does nothing to help.

I've given up selling stuff on ebay, I'd rather give or throw something away than have the hassle of finding suitable boxes and time spent packaging, drive to post office in lunch hour, deal with muppets who don't pay for a week, pay extortionate fees to ebay and paypal and be left with naff all after the hassle.

I sold a Mad Bull that was about a year old in mint condition on ebay, with controller battery, charger, in original boxes, nicely painted for £35 posted. Allegedly the speed controller subsequently burnt out taking the resistor with it and she demanded I pay for a new one or receive bad feedback. I refunded some money and that pretty much finished ebay for me. Nowadays the fees make it unfeesable ;) hoho.

Why not use the trades on TC? If you're not currently a member, you'll save the membership fee in ebay fees you no longer have to pay. There's obviously no protection for either party, but I think in some ways that's better than ebay's highly weighted buyer protection...

It's crazy the way ebay works (or how some people use ebay). I've bought items in the past that haven't been in quite as good condition as I hoped they would be, but this hasn't been through the seller being deceitful - yes, the photos may have been taken with the aim of making the item look it's best, but I'm the one who has studied the photos and the descriptions have been honest, though not detailed.

For example I could have taken issue with a description that states 'a well used condition' when really it should have stated 'bashed to within an inch of it's life, scratched to pieces but nothing broken' - it's how I interpret the description and what I expect that are the issue, not the seller (unless they send something that clearly doesn't match the shown product).

We're not all like that though Chris, I think you've just been unlucky with this Mr Kirby

But that is how eBay allow people to operate, outside of the sphere of what is socially acceptable behaviour.

Still no response from the buyer yet, but I'll post it up here when / if it eventually materialises!

Buyer left negative feedback. Request for return 'case' still open.

Are eBay even listening? I reported this guy ages ago, he hasn't had the guts to reply to my message above - but instead just left negative feedback.

Feedback left was:

"Discription incorrect. Contacted seller, responsed then nothing.Tried repeatedly"

I won't even start on the spelling of that, but it does kind of answer the question as to why he didn't 'responsed' to my message.

Good on you for getting your point across. It may cost you a negative feedback, but you've taken the MORAL high ground, which still matters to some people....

I have only managed to resolve issues when speaking to a human,who can read all the correspondence too.

I thought that might work too, but have become disenchanted with them after a recent purchase. Seller was selling a Tekin G420 ESC with box and decals, as well as a couple of low-turn brushed motors. I duly won the auction for just over AUS$22, a bargain price, but apparently what these things go for on the open market. Seller sends me a message that "there was a reserve" ( :blink: ), and I would have to pay AUS$135 to get my item..... did I mention that I had already won the item for just over AUS$22???

So I pay the guy anyway, and he laughs at me and wishes me luck on getting my money back.... so I send all the information to eBay by reporting the seller and the auction, and wait and see what happens. In a complete shock, eBay ALLOWS HIM TO CANCEL THE AUCTION!!!! No input at all from me, just cancelled! He used the excuse of "Item no longer available", and we all know what that means.... "I didn't get enough money for it".

Surprisingly, I get my money back, but it's not good enough, so I go through the motions of contacting eBay by phone, and talk to some robot, who assures me that the seller will be 'punished'. I don't really believe it, but what can you do....

A week later, the seller has relisted the item!!! Remember, the item is no longer available.... and yet, here it is, relisted for AUS$135 BIN! Would you believe, there's NO ACTUAL EASY WAY to report this type of activity..... as there is nothing in the eBay system that lines up with "something that was sold then cancelled then put up for sale again", and they don't allow you to type your own reasons in the reports any more. Another call to the eBay robots, "we'll punish him with the eBay system".... and the seller gets away almost scot-free. Well, except for my negative feedback. Seller has relisted the same item many times; last time I saw it was at AUS$100 BIN.

Anyway, thanks for letting me share my story and vent my spleen.... and good luck to Chris on getting a positive resolution!

I hate Ebay and yet find it a necessary evil. Sadly loads of people I come across don't know this site exists so it does open up a market for me that I wouldn't otherwise have. Apart from general parts all my projects and hard to get stuff comes from Japan and direct from overseas model shops. Surprising what shops have when you ask them.

Don't get me going on best offer though and what people think I will happily take. On Ebay for £100 that obviously means I will take £10 for it! Oh and I can get abuse when I refuse.

Ebay have had to move heavily towards protecting buyers as sellers don't seem to be an issue. Personally I have been held to ransom by many sellers in the past when they could leave a negative......

It gets better!

This guy has now asked eBay to step in and provide assistance with his case. I've just received an email stating that all messages will be reviewed in the next 48 hours to resolve this case.

eBay did that to a sale of mine recently. I was selling an old sewing machine for my wife, worked fine but took a while to get use to. Sale went through so I posted it off with the instructions... got a message a few days later saying the buyer wasn't happy with it, couldn't get it to work and they wanted to return it. I pointed out that the auction clearly stated no returns and suggested to read the instructions as it took some time to get use to.

They still werent happy and opened a case against me immediately forcing me to accept the return, like I'm some flipping shop that has to take back something if you chance your mind about it 😠

They didn't reply to my questions about whether it was damaged in the post, everything went quiet.

I've just heard from eBay that the case was found in my favour as the buyer hasn't responded or returned the item in time 😳 Don't hear many of those stories about eBay do you 😏

I phoned eBay today and they had a look at the case,they have advised the buyer to return the item within the next 10 days. If nothing turns up, or they are in a different condition to that which I sold them, I need to phone them back.

Guy lives in a really rough looking council flat though, what do you expect!

Did you ring Ebay again & ask why ?. This is not good & some thing needs to be done about this ... Why let it go . I would be on

that phone so fast it would have cought fire & not let go till some thing was done about it . They had to return item & have not done,

by ebay request . Ebay is NOT doing there own rules , court action needs to be done . if they don't comply ?.

No, it's not legal. I would have a chat with ebay and if that doesn't work I would seriously consider reporting it to the police. I know it's a relatively small amount of money but that doesn't really come into it. I think it's called 'obtaining goods or services by deception' and it is a criminal offence. You've got the guy's name and address, pass it on and see what happens. You may or may not get your stuff back but hopefully the little scumbag will have a rather uncomfortable conversation with the law!
