Hi all,

I was just about to bid on an auction when I read this line:" Payment must be recieved within 10 days of the end of the auction or buyer will forfit payment in transit."

to me that means if I take a couple days to get out payment, and the post office is a little slow, I could potentially lose my cash, and not get the item. I know it's a pain to have a non-paying bidder, but you can get the final fee refunded, and listing fees generally pale in comparison the the ending price of an item.

Is this legal?

This forfeit of payment "deal" would constitute mail fraud if payment was received by seller, and not returned to buyer.[:0] A legitimate method of handling slow-pays would be to mention... "If payment is not received, within 10 days of auction's end, late payment will be returned and transaction will be cancelled". I'd be afraid even this statement would discourage even the BEST buyers, though.[V] Sellers have to accept slow-pays and "excuses" once in a while!

I agree that this is a means to weed out time wasters. I bought a side fairing for a Thundercat motor cycle for a mate and the terms where 20% deposit within 48hrs and payment within 7 days....

When I contacted the seller and explained that it was not physically possible to achieve this due to the time the auction ended, he said no problem.

Moral of the story, always ask the seller questions about anything that bothers you. You may be suprised at the answer, and go on to win that auction more in your favour.
