Bought something off the 'Bay' and paid for it 7th September. Seller asks if I'm going to collect it cos its too big to post....he's in Folkstone and I'm local, (NOT!!) in Glasgow [:o)]

So he arranges a courier and charges me £21 shipping...a bit pricey but the stuff came cheap so...

After a month nothing turned up and I couldn't get any answers to emails and he wouldn't speak to me on the telephone so I put the matter into the hands of the Paypal Resolution Centre, who, after 10 days re-funded my credit card with the full amount less £15. Paypal stated that the seller had insufficient funds to refund me the full amount and they will continue to pursue for the remaining sum.

I've got to say that I'm well happy about this but it got me wondering if somebody were to claim that I had not sent anything to a buyer would my credit card be debited without my authorisation or is Paypal only allowed to debit your Paypal account assuming its in funds? I haven't managed to get a precise answer to this question from Paypal. Certainly an area for concern and an arguement to obtain proof of posting on all dispatches.

Anybody got any stories and can the episode recounted above come back and bite me in the bum if the seller appeals?

It happened to me, I sold some monster beetle parts and the guy claimed he never got them eventhough he was running auctions that contained my parts. But since I didn't use delivery confirmation, he won and my account got debited.

So I learned that you always have to ship using a verifiable delivery method and to the address listed on their paypal account. but I believe I am exempt from that rule when shipping internationally

the only way they can debit your credit card is if you have confrmed your details but without this, they can only put you paypal account in debit as i recntly found out grrrrrr[V]

as sold a mobile phone on the bay, funds were xferred and i sent the phone special delivery, (so its trackable, always sent trackable, whather it be registered or special) as paypal resolution centre always require faxed copies, if not then it most certainly always goes against the sender. so anyway he says he never received the phone, so i gave him the tracking id number, but as i sent it to an army base they couldnt track it past getting delivered to the base. so started the paypal resolution centre, who debit my online paypal accoutn with 134 quid, as you can probably guess i wasnt gonna be using my accoutn for a while [:(]

i decided to report the phone stolen which blocks the phone from making or receiving any calls, and oh look he emails me to says he's got it but it doesnt work, the slime twit was tryin to pull a fast one, plus in the mean time i had faxed the trackable details to paypal.

so the matter was sorted out in my favour yeah, payapl aint bad but they do like the proofs and so on.

so please bear in mind when sending owt by post the get the tracking id, proof of postage aint enough, just so your all aware and no one on here gets done by the system[;)][8D][:D]

my friend runs a store and once in a while he has some cell phone for sale online. people would buy from 1 to large quantity of phone, use other people's credit card and ship to other countries, most often Nigeria. a month after sale original credit card owner of course would dispute the charge on the credit card, after fights between my friends company and the bank eventually the company would lose and funds are withdrawn back to the bank. doesn't happen to RC toys but very often on cell phone. so beware when selling phones.

I've also heard sellers send out empty box with heavy trash in there.

so they have tracking no. and prove of postage. buyers very often lose their case because sellers has proe of everything. thats why I still dont trust buying phones online. not to mention i got trickes once too. for some reason scam happens very often on cell phones and lab tops, maybe they are small and expensive....

I havent read the paypal terms and conditions thoroughly, but surely they cant debit your credit card without your authorisation even if the card is confirmed. Could they ??

When you make a payment you are authorising them to withdraw money from you card to transfer to another account, for them to withdraw money to transfer to another account on what is effectivley someone elses say so, without your permission, is frightening to say the least.

This could open the door to all sorts of nonsense, the only way, if you had a valid reason, to stop it I would presume would be to contact your card company and put the claim into a dispute, I belive the funds still take time to actually leave your credit card account, I could be wrong on this its kind of guesswork.

None the less it is a worrying scenario.

Be afraid... very afraid, paypal are a law unto themselves, I'm sure it even says somewhere in the epic novel that is their terms and conditions that they own your soul and can take your first born child if the whim possesses them.

They are not allowed to do this (ignore their t&c's - Visa / Mastercard regs requires you to personally give permission for each debit) so if they did you could initiate a charge back against them via your bank.

The problem is that if you've put a direct debit bank account on their then they *can* debit that since you've already given them wide ranging permission to debit any value from that.

Anyone know what happens if you have put a bank account on to confirm your ID and then choose to "remove" the account but "accidentally" forget to put a replacement account on?

I thought it was illegal to debit any money from ones account without authorization so I dont think they can do that at all. thats very scary to hear I thought when your in dispute and your the person who got the disupte they will take whatever moneys in your paypal account and give it to the others who disputed you not actually take money from your bank account. At least thats what I happened to me when I disputed they always wrote,"person had no money in paypal account" anyways thats why I always clear out my paypal account the minute I get money...

Jock - dead right, that's why I'm very wary of them insisting you add a direct-debitable bank account (as they have for a lot of uK users very recently) - card they cannot debit without your permission, but if you look at the terms you sign up to when you put on a bank account because it's a direct debit they basically can take the money and then you have to contact your bank and prove it shouldn't have been taken before you can get it back.

I suspect eBay then send debt collectors round if this happens and it's worth their while, although it wouldn't be for a hundred or so, but if it's 500 or more then could be dodgey.

My opinion anyway, I'm no lawyer but the T&C with this outfit is more Disney than most.
