Hi I bought 2 sets of wheels with tires as a Buy it now off a well known seller on E-bay

Paid for the items and shipping there and then that was on Wednesday. This morning I get an e-mail from the seller saying there was a listing error and PayPal have sent a refund. Now I know everyones human and people make mistakes but the items are now showing in my e-bay home page as unpaid and when I try to pay the amount is 3 times what I originally paid.

So where do I stand if I don't pay can they open a dispute what happens about feedback? should the seller do the honourable thing and just stick to the original price after all they should have checked the listing.

any advice or view on this please

this has never happened to me ,but im sure if you email the seller they will let you out of the deal.

or contact ebay and explain it to them.

very much doubt if you will get it for the original price.

I think the seller should just send you the stuff you paid for. By clicking on the BIN option you BOTH entered into a contract. You have honored your side of the bargain, so he should honor his. There can be no question of a dispute being initiated against you. It would be commercial suicide for the seller to do that.

I think Snakehands is right. If I understand you correctly it is the seller who has broken the contract. If you used the buy it now then the price is set, the seller can't decide afterwards that they want to charge more for it.

On the other hand though like you say, people are human and mistakes are made. To be honest it would depend on how much of a mistake it was. Obviously if a seller had accidently listed a Unimog kit for $1.00 then I honestly don't think they would be expected to honour that, thats just an example.

If it were me I think I'd just send the seller an email saying thanks but no thanks.

I don't think you'll have any trouble from a dispute being opened against you as you were not at fault, the seller was.

I've had times where I have bought something and then not been able to complete the transaction. So long as you communicate then it should work out ok and if the seller wants to get stupid about it let them, ultimately it will only result in reflecting badly on them.

Contact eBay live and see what they say about it. I'm not sure how it works with BINs. Auctions I'm sure they have until 24hrs left to fix any listing errors, after that the sale price is the contract price afaik.

I've seen listings that were obvious errors and when the BIN was tried the transaction couldn't be completed once the seller noticed the error. It was a NIB at a crazy cheap price.
