WARNING The following post contains a bit of a rant!

Just wanted your opinion on this ebay trade that's gone south this morning.

I've been looking for a cheap 2ch 2.4ghz radio to use on the DT02 event at the end of the month. Both my runners have AM sets and I figured it'd be less hassle and safer to replace them with a digital set.

This morning while browsing eBay I found this:

It's obviously been parted out of a Maverick RTR car, I've not had any probs with my Scout radio so figured its worth a punt. Seeing the 99p price I assumed it was an auction but when I tried to place my bid I realised it was the BIN price! I doubled checked the description and postage page to confirm it wasn't damaged or collection only and all seeming well paid my money. I figured the seller has over 500 items for sale so hes probably a shop and wanting to drum up business... or a muppet that likes pressing "ok" without checking their listing. The usual automated "congratulations" and PayPal emails arrived and I was feeling pretty good.

30 mins later I get this message from the seller

"sorry bud price was a misprint - modelforceuk"

Not totally surprising but as a trader in the UK he's governed by the same laws as everyone else right? You advertise an item at a price (even if its the wrong price) and someone buys it, then that's they price they pay. It's the sellers fault for the error and they take the hit and hopefully learn to not make that mistake again right?

So I send him a polite message saying as much.

While I'm doing that a get a PayPal refund from the guy and here's his reply

"you are very quick as will give you that. only done the price about 30 seconds ago. if I see a mistake I would email the people quick like. you are right unless a mistake in the advertised price is made which does happen. Paul modelforceuk"

Now pardon my Klatchian but that's horse $h1¥!

I've messaged him back with this:

"30 seconds??? I paid for this item 35 minutes ago! You made a mistake, that's your bad. The law says you have to suck it up and honour the trade, learn from it and don't make the mistake again buddy. I expect this item to be posted to me as agreed in your auction for the price you advertised it at. If you don't do that I will be opening a case with eBay and Trading Standards.

The balls in your court, be a man or stop playing the game!"

And it's all gone quiet...

Now I know it's only 99p, I appreciate mistakes happen but it annoys me how he's reacted and just dismissed his responsibility. I've been lucky Ive not had an eBay sale go all gooey for a long time so it grinds my gears.

I should probably just forget it. If I leave neg feedback he'll likely just go the same for me (which has happened in the past).

Any thoughts? Am I write in my understanding of UK trading laws? Is there any point in perusing this? He's already relisted the item at £32.99!

Actually, I'm not sure he does have to sell it to you for the stated price if it is a genuine error, otherwise people could be seriously out of pocket. Would you hold somebody to a 99p price if they were selling a car?

However, as dyahipfakta says, he can't leave you a negative, so if I was him, I would at least be trying to meet you with some sort of compromise.

I don't think he has to sell it, or there is anything you could do about it really.. Like said I'd try and do a deal at a realistic price..

I've done it before listing on my phone, it was already on fixed price rather than auction and I started something at 99p BIN but realised and changed it, the item was worth £500, so would I have sold it at 99p? No chance! He can leave negative comments in your positive feedback, and eBay wont remove them if he does, unless he uses threatening or slanderous comments..

Hmmm... thanks for that link gruntfuggly. I'm not out of pocket so best thing is to let it go I guess. Annoying but I don't want to turn into some bitter old man with nothing better to do than pursue a sour 99p deal!

Saying that, should anyone want to contact the seller of this relisted item http://bit.ly/15zVEiv and ask him for a bogus overseas postage quote, I'd get a certain satisfaction knowing he's had a little of his time wasted today :)

the seller quotes international postage rates but I've sent him a enquiry for a bogus address in Zambia - actually my deceased Dads former farm lol . That should waste some of his time .

id let it go mr crispy its only 99p and a lil time wasted but on the other hand if you made the mistake would you let a £30 odd transmitter go for 99p once you relised you put the wrong price on. might of been a genuine mistake. unless you have a dig on his neg feedback if he has any and see what other people are saying about him. then if he has cases of similar things then re evaluate the situation that's what id do anyway bud.

forums are dangerous things for sellers on ebay ive known a couple of sellers get persecuted from upset forums with the members going crazy giving them there 2 penith arguably the sellers brought that on them selfs though so got what they deserved in the end.

in 12 months he has had 8 neg feedback and 4 neutral comments which isn't bad considering his score 17135 overall so id say it was a genuine mistake with his listing or he would have a lot more than 8 neg feedback.

Looks like a genuine mistake and I feel you could have a) been less aggressive and B) not negatively advertise the poor guys name over a public forum.

30 secs, 30mins, big deal. He is clearly listing a lot of stuff everyday so its an oversight.

Just my thoughts.

All fair comments. I can't help feeling that a little more effort on his part would've been appreciated as its was his error. He appears to have refunded me and then dismissed me.

I felt it was right and fair to mention him on this forum so fellow members are aware of him. That is not a good way to do business and forums are for promoting good service and warning of the bad ones.

I didn't read it as too aggressive, in my mind I was pointing out his obligations as I understand it in regards to trading laws. But then I worked in a car breakdown call centre for 9 years so my idea of aggression is rather skewed by the kind of abuse I was exposed to there :)

Now I've cooled down it does sound like he made a mistake, he could've been a little more apologetic in his replays though.

Besides how many flipping times does eBay asks you to confirm what you've put on a listing before publishing it?

If you're listing through the mobile app it's all to easy to make an oversight.

I sold a job lot of tamiya rattle cans and made them collection only due to being a prohibited item to send. I even removed the postage option to collection only yet it still put a nominal figure for postage, even the description quite clearly states collection only, but the buyer is adamant I'm going to send him 20 odd tins for £3...

I'd let it go, has the seller asked for the transaction to be cancelled?

I am big fan of your work mr crispy, but this post does feel harsh and whilst it was frustrating I feel the thread should be deleted.

Sorry but I have to agree with that . Its gone a little too far . The seller made a mistake - heck that's life .

I wasn't trying to be harsh if you read my post above this one grumpy pants I was trying to point out that his feedback esp negative doesn't suggest its a regular thing that he tries to mess his customers about. no harshness there esp if you re read what I put above it.

I agree with you the seller has really strong feedback with a tiny amount of negative feedback, which is quite an undertaking on eBay.

I didn't think you are being harsh at all and I think your post was on the money.

Yeah I started this thread when my blood was up, venting my frustration. It's all water under the bridge now.

Genuinely i wanted to say thanks for sharing your opinions guys, it's good to get someone else's take on a situation. It can be hard to step back and take a fresh look when you're still annoyed. I mean, why am I moaning... as bad eBay trades go I'm not actually out of pocket at all and it was resolved in 30 mins. I'm sure we've all had a lot worse right?

Must learn to let irrelevant stuff go... chill out man... go drive some cars :)

Well it's a bit off topic but I've taken on a commission to build a 1/6 scale landing craft... Think about that for a minute, it's a LCVP Higgins boat as seen in Saving Private Ryan for 12 inch high action men dolls. The flipping thing is going to be apx 6ft long and 2ft wide... not only am I building it from scratch but I need to post it to Northern Ireland! We're just sorting out the fine details and trying to find a courier that'll do the delivery job!

Should be fun :)

no problem with couriers mr crispy , i can give you a number for a mate who delivers hand built race car models all over europe personally in his van , he will collect from your premises and deliver on your behalf , not pass it over to a third party to be thrown around a warehouse etc . jon
